The Justice Division stated Wednesday that it was defying a subpoena from Home Democrats on the Oversight Committee for testimony this week from John Gore, the official who leads the division’s civil rights division, as a result of the committee isn’t permitting a DOJ legal professional to be current.
“Consistent with longstanding Division of Justice coverage, neither Mr. Gore nor anybody else within the Division shall be compelled to testify of their capability as a DOJ official on DOJ issues with out DOJ counsel,” division spokeswoman Kerri Kupec stated.

A deposition with Gore had been scheduled for Thursday. Assistant Lawyer Common Stephen E. Boyd wrote in a letter to Oversight Committee Chairman Elijah Cummings, D-Md., that the committee’s “exclusion of company counsel from a compelled deposition would unconstitutionally infringe upon the prerogatives of the Government Department.”
A DOJ official instructed Fox Information, “Mr. Gore has the Lawyer Common’s unqualified assist on this matter.”
Boyd wrote in his letter to Cummings that the committee supplied to permit a DOJ lawyer to be “current in a separate room throughout the deposition,” however DOJ rejected that provide.
